Terms of Service

1. Acceptance of the Terms

By accessing or using the Service you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.

If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

2. The Service

nuVpn provides managed private VPN servers with a dedicated or shared IP address, encrypted tunnelling and built-in DNS-level protection that blocks phishing, malware, ads and trackers.

We provision, operate and maintain the underlying servers on your behalf. Features, locations and add-ons may change over time as we improve the Service.

3. Eligibility and Account

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are responsible for providing accurate registration information and for keeping your account credentials confidential.

You are responsible for all activity that occurs under your account. Please notify us immediately of any unauthorised use.

4. Acceptable Use

You agree to use the Service lawfully. You may not use it to send spam, distribute malware, infringe intellectual-property rights, engage in hacking, fraud or harassment, distribute child sexual abuse material, or carry out any activity that is illegal under applicable law.

You may not resell, sublicense or abuse the Service in a way that degrades performance for others or violates the rights of third parties. We may act against accounts that endanger the network or other users.

5. Subscriptions, Billing and Auto-Renewal

Paid plans are billed in advance on a recurring basis (monthly or yearly) at the price shown at checkout. By subscribing you authorise us and our payment providers to charge your payment method for each renewal period.

Subscriptions renew automatically at the end of each period unless auto-renewal is disabled in your account before the renewal date. Prices may change, and we will give reasonable notice before any change affects you.

6. Traffic Quota and Overage

Each plan includes a monthly traffic allowance measured over the calendar month. Usage beyond your included allowance is billed per gigabyte at the published overage rate, or may be limited, as described for your plan.

We measure the aggregate volume of your traffic only for quota and billing purposes — never its content.

7. Cancellation and Refunds

You may cancel at any time from your account profile. Cancellation stops future renewals; your Service remains active until the end of the period you have already paid for.

Every purchase is covered by our 30-day money-back guarantee as described in the Refund Policy. Beyond that window, and except where required by applicable consumer-protection law, payments are non-refundable. Where a statutory right of withdrawal applies, we honour it in accordance with the law.

8. Availability and Support

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. Maintenance, upgrades or events beyond our control may cause temporary interruptions.

If a dedicated IP address becomes blocked by a third party, we will endeavour to replace it as part of the managed Service.

9. Intellectual Property

The Service, including its software, applications, trademarks and content, is owned by nuVpn or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.

You may not copy, modify, reverse-engineer or create derivative works from the Service except as permitted by law.

10. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

While the Service includes built-in DNS-level protection that blocks known phishing sites, malware, ads and trackers, no security measure can block every threat. We do not warrant that the Service will prevent all malicious content, and to the fullest extent permitted by law we are not liable for any damage, data loss, infection or breach resulting from viruses, malware, hacking or other harmful activity that the protection does not catch. You remain responsible for maintaining your own security measures.

To the maximum extent permitted by law, nuVpn shall not be liable for any direct, indirect, incidental, special or consequential damages, and shall not be required to pay any compensation or indemnity in connection with your use of, or inability to use, the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Suspension and Termination

We may suspend or terminate your account if you breach these Terms, fail to pay, or use the Service in a way that harms the network or other users. Where reasonable, we will give notice and an opportunity to remedy the issue.

You may terminate your account at any time by cancelling your subscription and ceasing to use the Service.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by posting the updated Terms with a new "last updated" date and, where appropriate, by notifying you directly. Continued use after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-law rules. The competent courts in Israel shall have exclusive jurisdiction, except where mandatory consumer law grants you the right to bring proceedings in your place of residence.
